1 ـ این فصل شامل محصولات علوفه‌‌ای شماره 1214 نمی‌شود.
2 ـ در شماره‌های 0709، 0710، 0711، 0712، عنوان «سبزیجات» همچنین شامل قارچ‌های خوراکی، دنبلان‌زمینی، زیتون،کورز (Capers)،کدوی مسمایی،کدوی تنبل، بادمجان، ذرت‌شیرین (Zea mays) از نوع (Saccharata)، فلفل فرنگی از نوع (Capsicum) یا از نوع (Pimenta)، شبت، مرزه و نباتات جالیزی مانند جعفری، گشنیز، ترخون، تره تیزک و مرزنجوش زراعتی Origanum majorana) یا (Majorana hortensis می‌شود.
3 ـ شماره 0712 شامل کلیه سبزیجات خشک کرده از انواعی‌که در شماره‌های 0701 لغایت 0711 طبقه‌بندی گردیده، می‌شود، باستثنای:
الف ـ سبزیجات غلافدار خشک کرده،غلاف کنده (شماره 0713)؛
ب – ذرت شیرین به اشکال مشخص شده در شماره‌های 1102 لغایت 1104؛
ج ـ آرد، زبره (Meal)، پودر، برگه، دانه‌ریز (Granules) و به هم فشرده به صورت حبه (Pellets) از سیب‌زمینی (شماره 1105)؛
د – آرد، زبره (Meal) و پودر سبزیجات غلافدار خشک‌کرده شماره 0713 (شماره 1106).
4 ـ با این حال فلفل‌فرنگی از نوع (Capsicum) یا از نوع (Pimenta) به صورت خشک کرده یا خرد کرده یا ساییده از این فصل مستثنی می‌شود (شماره 0904)
مندرجات ذیل یادداشت فصل 7
1ـ ورود هر نوع بذر برای کشت، حبوبات، سبزی و صیفی‌جات و میوه‌جات تازه و آماده نشده مشمول این فصل موکول به رعایت ماده 11 قانون حفظ نباتات مصوب 1346 میباشد.
2- حقوق ورودی بذر حبوبات، سبزی و صیفی‌جات مشمول این فصل 4 درصد ارزش میباشد.
3ـ ورود انواع مواد خوراکی آماده مصرف، بسته‌بندی شده یا کنسرو شده مشمول این فصل موکول به رعایت ماده 16 قانون مواد خوراکی، آشامیدنی و بهداشتی مصوب 1346 است.
4 – ورود بذر و نباتات که در اسناد صدور کشور مبدأ مشخصاً دست‌ورزی‌شده محسوب می‌شوند یعنی با تغییرات ژنتیکی تولید شده‌اند از لحاظ بررسی خطرات زیست‌محیطی موکول به تایید سازمان حفاظت محیط زیست میباشد.
5– صدور بذر و نهال در مقیاس تجاری منوط به اخذ گواهی از مؤسسه تحقیقات ثبت و گواهی بذر و نهال و با رعایت مقررات قرنطینه میباشد.
6– ورود و صدور موجودات زنده ت ییر شکل یافته ژنتیکی و محصولات تراریخته ملزم به رعایت مفاد قانون ملی ایمنی زیستی با کسب مجوز قبلی از وزارت جهاد کشاورزی میباشد.
Chapter 7
Edible vegetables and certain roots and tubers.
Notes.
1. This Chapter does not cover forage products of heading 12.14.
2. In headings 07.09, 07.10, 07.11 and 07.12 the word “vegetables” includes edible mushrooms, truffles, olives, capers, marrows, pumpkins, aubergines, sweet corn [Zea mays var. saccharata], fruits of the genus Capsicum or of the genus Pimenta, fennel, parsley, chervil, tarragon, cress and sweet marjoram (Majorana hortensis or Origanum majorana).
3. Heading 07.12 covers all dried vegetables of the kinds falling in headings 07.01 to 07.11, other than:
(a) dried leguminous vegetables, shelled (heading 07.13);
(b) sweet corn in the forms specified in headings 11.02 to 11.04;
(c) flour, meal, powder, flakes, granules and pellets of potatoes (heading 11.05);
(d) flour, meal and powder of the dried leguminous vegetables of heading 07.13 (heading 11.06).
4. However, dried or crushed or ground fruits of the genus Capsicum or of the genus Pimenta are excluded from this Chapter (heading 09.04).
Explanatory remarks to Chapter 7
1. Importation of any kind of seeds for planting, pulses, vegetables and fresh fruits which are not prepared and are classified in this chapter, is subject to the observance of Article 11 of the Plant Protection Law adopted in 1967 (1346).
2. The import duty benefit on any kind of seeds, pulses 6 Vegetables classified in this chapter is 5% of the value.
3. The entry of foodstuffs ready for consumption, packaged or canned, classified in this chapter is liable to the observance of Article 16 of the Law on Foodstuffs and Beverages adopted in 1967.
4. The entry of seeds and plants which, according to the export documents of the country of origin, have been identified as genetically modified shall be subject to the approbation of the Environment Protection Organization in terms of any environmental dangers.
5. import and export of genetic transformed living creatures and transgenic products bound to save national, security and biological legal provisions with the previous authorization of ministry of jihad agricultural.
6. The exportation of seeds and saplings on a commercial scale shall be subject to a certificate obtained from the Institute for the Research, Registration and certification of seed and sapling and to compliance with the quarantine regulations.
