شیر و محصولات لبنی؛ تخم پرندگان؛ عسل طبیعی؛ محصولات خوراکی که منشأ حیوانی دارند و در جای دیگر گفته نشده و مشمول شماره دیگر تعرفه نشده باشد.

فصل 4
یادداشت‌ها.
1 ـ شیر چربی نگرفته و شیری که چربی آن جزئاً یا کلاً گرفته شده باشد به‌عنوان شیر تلقی می‌شود.
2 ـ به مفهوم شماره ۰۴۰۵:

الف ـ واژه‌ «کره» به کره طبیعی، کره آب‌ پنیر (کره لاکتوسرم «Whey») یا کره «دوباره ترکیبی» (تازه، نمک‌زده یا ترشیده (Rancid)، همچنین کره در ظروف کاملاً مسدود) اطلاق می‌شود که منحصراً از شیر مشتق گردیده و میزان مواد چرب شیر آن از لحاظ وزن بیش از 80 درصد ولی از 95 درصد بیشتر نباشد و حداکثر میزان مواد غیرچرب جامد شیر از لحاظ وزن درصد و حداکثر میزان آب از لحاظ وزن ۱۶ درصد باشد. کره حاوی مواد امولسیون کننده اضافه شده نبوده ولی ممکن است دارای کلرور سدیم، رنگهای خوراکی، املاح خنثی‌سازی و کشت‌های باکتری‌های لاکتیک غیرمضر باشد.

ب ـ اصطلاح (خمیرهای لبنی برای مالیدن روی نان «Dairy spreads») به امولسیون‌های از نوع آب در روغن اطلاق می‌شود که منحصراً دارای ماده چرب شیر به عنوان تنها ماده چرب در محصول باشد، مقدار چربی شیر آن از لحاظ وزن برابر یا بیشتر از 39 درصد بوده لیکن کمتر از 80 درصد وزنی باشد.
9 ـ محصولاتی که از تغلیظ آب پنیر (لاکتوسرم Lactoserum) و با افزودن شیرهای مواد چرب شیر به‌ دست می‌آیند به‌عنوان پنیر در شماره 0406 طبقه‌بندی می‌شوند مشروط بر اینکه دارای سه مشخصه زیر باشند:
الف ـ میزان مواد چرب شیر، از لحاظ وزن نسبت به ماده خشک آن 5 درصد یا بیشتر باشد؛

ب – میزان ماده خشک آن از لحاظ وزن حداقل 70 درصد و حداکثر 85 درصد باشد؛ و

ج ـ به شکلی درآمده یا مناسب برای شکل‌گیری باشد.

4 ـ مشمول این فصل نمی‌شود:

الف ـ محصولات حاصل از آب پنیر (لاکتوسرم) دارای بیش از ۹۵ درصد وزنی لاکتوز، بیان گردیده به صورت لاکتوز بی‌آب و محاسبه شده برحسب ماده خشک (شماره 1702)؛ یا

ب ـ آلبومین‌ها (همچنین غلیظ شده‌های «کنسانتره‌های» دو یا چند پروتئین آب‌ پنیر، حاوی بیش از 80 درصد وزنی پروتئین‌های آب پنیر، محاسبه شده بر حسب ماده خشک) (شماره 3502) یا گلوبولین‌ها (شماره 3504).

یادداشت‌های شماره‌های فرعی.

1 ـ به مفهوم شماره فرعی 040410 منظور از اصطلاح «آب پنیر تغییریافته Modified» محصولاتی هستند حاوی اجزاء تشکیل‌دهنده آب پنیر، به عبارت دیگر آب پنیری که از آن تمام یا جزئی از لاکتوز، پروتئین‌ها، موادمعدنی، گرفته شده‌ باشد یا آب پنیری که به آن اجزاء تشکیل‌ دهنده طبیعی آب پنیر افزوده شده باشد، و همچنین محصولات حاصل از اختلاط اجزاء تشکیل دهنده طبیعی آب پنیر.

2 ـ به مفهوم شماره فرعی 040510 واژه «کره» شامل کره آب گرفته (Dehydrated butter) یا (Ghee) نمی‌شود. ( شماره فرعی 040590).

مندرجات ذیل یادداشت فصل ۴

1ـ ورود کلیه کالاهای این فصل ( باستثنای تخم‌مرغ نطفه‌دار) موکول به رعایت ماده ۱۶ قانون مواد خوردنی و آشامیدنی … مصوب 1346و ترخیص آنها موکول به ارائه گواهینامه بهداشت کشور مبدأ می‌باشد.

2ـ ترخیص تخم پرندگان موکول به ارائه گواهینامه بهداشت کشور مبدأ بوده و منحصراً از گمرکخانه‌هایی‌که دارای پست قرنطینه دامی وزارت جهادکشاورزی می‌باشند قابل ترخیص است.

3 ـ ورود و صدور تخم پرندگان وحشی موکول به موافقت سازمان حفاظت محیط زیست می‌باشد.

4 ـ ورود فرآورده‌های مخصوص تغذیه کودکان شیرخوار مشمول ردیف 0403 به تشخیص وزارت بهداشت، ‌درمان و آموزش پزشکی می‌باشد.

5 ـ ورود تخم نطفه‌دار مرغ و سایر ماکیان به تشخیص وزارت جهادکشاورزی است.

6 ـ حقوق ورودی شیرخشک اطفال در بسته‌بندی‌های تحت خلاء و یک کیلوگرم و کمتر و به میزان مصوب شورای اقتصاد یا مصوبات دولت مشمول 4 درصد ارزش است.
7- جهت اطلاع از فهرست کالاهای معاف مالیات بر ارزش افزوده به ضمیمه شماره 8 مراجعه شود.

Chapter 4

Dairy produce; birds’ eggs; natural honey; edible products of animal origin, not elsewhere specified or included

Note.

۱٫ The expression “milk” means full cream milk or partially or completely skimmed milk.
۲٫ For the purposes of heading 04.05:
(a) The term “butter” means natural butter, whey butter or recombined butter (fresh, salted or rancid, including canned butter) derived exclusively from milk, with a milkfat content of 80% or more but not more than 95% by weight, a maximum milk solids-not-fat content of 2% by weight and a maximum water content of 16% by weight. Butter does not contain added emulsifiers, but may contain sodium chloride, food colours, neutralising salts and cultures of harmless lactic-acid- producing bacteria.
(b) The expression “dairy spreads” means a spreadable emulsion of the water-in-oil type, containing milkfat as the only fat in the product, with a milkfat content of 39% or more but less than 80% by weight.
۳٫ Products obtained by the concentration of whey and with the addition of milk or milkfat are to be classified as cheese in heading 04.06 provided that they have the three following characteristics:
(a) a milkfat content, by weight of the dry matter, of 5% or more;
(b) a dry matter content, by weight, of at least 70% but not exceeding 85%; and
(c) they are moulded or capable of being moulded.
۴٫ This chapter does not cover:
(a) Products obtained from whey, containing by weight more than 95% lactose, expressed as anhydrous lactose calculated on the dry matter (heading 17.02); or
(b) Albumins (including concentrates of two or more whey proteins, containing by weight more than 80% whey proteins, calculated on the dry matter) (heading 35.02) or globulins (heading 35.04).

Subheading Notes.

۱٫ For the purposes of subheading 0404.10, the expression “modified whey” means products consisting of whey constituents, that is, from which all or part of the lactose, proteins or minerals have been removed, whey to which natural whey constituents have been added, and products
obtained by mixing natural whey constituents.
۲٫ For the purposes of subheading 0405.10 the term “butter” does not include dehydrated butter or ghee (subheading 0405.90).

Explanatory remarks to Chapter 4

۱٫ The importation of all goods under this chapter (except hatching eggs) is subject to the observance of Article 16 of the Law on Foodstuffs and Beverages adopted in the year 1967. The clearance of these goods shall depend on the submission of health certificate issued by the country of origin.
۲٫ The clearance of birds’ eggs is subject to the submission of health certificate issued by the country of origin and may be carried out only through customhouses which have animal quarantine stations under the Ministry of Agriculture Jihad.
۳٫ The importation and exportation of eggs of wild birds are subject to the approval of the Environment Protection Organization. 4 ورود ترآورده
۴٫ The importation of products for feeding infants covered by subheading 0403 is subject to the discretion of the Ministry of Health, Treatment and Medical Education.
۵٫ The importation of fertile (hatching) eggs of hen and other poultry is subject to the discretion of Ministry of Agriculture Jihad.
۶٫ The Total customs duty and commercial benefit on powdered milk for the consumption of infants, vacuum-packed in packages of one Kg or less, within the amount approved by the Economic Council is 4% of the value.
